Man Indicted for 2010 Murder of Wasilla Woman

Today, 34 year old Simon Smith was indicted for the 2010 murder of lifelong Alaskan Nichole Millsaps. Millsaps went missing in late April 2010. Her body was discovered by a hiker in Indian, Alaska in February 2014.

Smith was indicted for one count of murder in the first degree and one count of murder in the second degree. His indictment comes as a result of a four year investigation by the Alaska State Troopers, which remains ongoing. Smith is expected to be arraigned in Anchorage Superior Court on March 21, 2014.

The indictment is only a charge and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.

If convicted, Smith faces a sentence of 20 to 99 years in prison and a fine of up to $500,000. Sentencing is based on the judge’s view of the seriousness of the crime and the offender’s criminal history, if any.
